SOFTWARE REGISTER

1.  COMPUTER PROGRAM

 According to the Law # 9609 of February 19th, 1998, it was established that the "SOFTWARE" computer programs would have the Copyright legal as a way of protecting the interests of whom develops them.

The National Institute of Industrial Property - INPI, federal autarchy linked to the Industry, Trade and Tourism Department, is the responsible organ for registrations of computer programs, in agreement with the Decree # 2556 of April 20th, 1998.

2. WHAT IS A COMPUTER PROGRAM?

A computer program is the expression of an organized group of instruction's in natural language or codified, contained in physical support of any nature, of necessary application in automatic machines of information treatment, instruments of outlying pieces of equipment, based on digital or similar technique, to make them work for certain ends.

3. WHAT IS THE VALIDITY PERIOD?

The validity period is 50 (fifty) years counting from January 1st of the year after the program was created, having the absolute secrecy of the parts of the program brought to register at INPI garanteed. The title-holder can indicate the date of the deposit of the requested registration like being the date of the program creation.

4. WHY DO I HAVE TO REGISTER  THE PROGRAM?

The registration occurs so that it can guarantee the exclusiveness in the computer program production, usage and commercialization, the one who's interested should prove the authorship of the same.

5. WHICH INFORMATION AND DOCUMENTS ARE NECESSARY TO INSTRUCT THE COMPUTER PROGRAM REGISTRATION?

• You have to present the program source, and descriptive memorial, internal functional specifications, flowcharts, sequence of commands that operate the referred program and other data capable to identify and to characterize the originality of the program;

• Power of attorney (model to supplied) with approved signature

• Assignment Document (when it refering to a depositing that isn't the program creator, and when there's no employment agreement outsourcing for this development), signed by the author and cessionary, two witnesses properly qualified and with all the approved signatures.

• Source program (two copies - original and photocopy)

Note: The program should be presented in paper A4, being allowed the used of the front and the back of the paper, and all of the pages should be initialed by the author and numbered as follows:

Document with one sheet only: 1/1

Document with three sheets: 1/3,2/3 e 3/3

The referred program source will be conditioned to each 07(seven) leaves in an involucre. It will be used as many involucres as it will be necessary for the protection of the document.

• You have to inform if it refer to technological modification or program derivation previously requested (if so, you have to inform the title of the original program)

• Field application program: 5 codes at most (list will be provided)

• Program type: 5 codes at most (list will be provided)

P.S.: It should be informed if the deposit will be made with or with no secrecy.

• If the program has been developed either via a contract of employment of outsourcing, a copy of the employment or outsourcing agreement should be presented
